The primary visa of interest to investors is the EB-5 immigrant visa petition. This visa is available to prospective immigrants who are prepared to invest between a half million and one million dollars in a U.S.-based business and create at least 10 full-time equivalent jobs for U.S. workers. This visa program leads to lawful permanent residence (green card status) in the United States.

The other programs applicable to investors and international businesspeople are the E and L visas.

  • The E-1 treaty trader visa and E-2 treaty investor visa are nonimmigrant visas based on bilateral treaties between the United States and certain other countries. E visas are nonimmigrant visas; however, the visas may be renewed indefinitely so long as the business continues to operate.
  • The L-1 intra-company transferee visa is available for multinational companies with U.S. operations or foreign companies that want to expand into the United States. L-1 visas are available to businesses that wish to transfer employees with specialized knowledge and those who are executives and managers. L-1 visas are nonimmigrant visas; however, L-1 visa holders are able to apply for an immigrant visa (green card) while in the United States.
