One of the stated goals of the U.S. immigration system is family unification. Toward that end, both U.S. citizens and lawful permanent residents (green card holders) can sponsor certain family members for immigrant visas. The process for this, however, is far from simple.

The rules for family-based immigration into the U.S. are based on the status of the sponsor and the relationship between him or her and the person being sponsored, as follows:

  • U.S. citizens can sponsor their spouses, minor children, adult sons or daughters, parents, and siblings.
  • Lawful permanent residents can sponsor their spouses, minor children, and adult sons or daughters.

If you want to reunify your family in the U.S. more quickly than the immigrant visa system allows, you may be able to apply for a nonimmigrant visa such as a K-1 fiancé visa or K-3 marriage visa. I can help you determine whether you qualify for any of these programs.

It is important to note that the immigration service may delay or deny your visa application if it believes you have entered into a fraudulent relationship for immigration purposes. I can help you document the nature of your relationship to dispel any concerns about fraud.
