Among the main immigration advantages offered to academic workers is the availability of a number of options for employment-based immigration that do not require labor certification under the Program Electronic Review Management (PERM) system, namely the following:
- National interest waivers: If the work that you do is considered important to the national interest of the United States, the immigration service may waive the lengthy and tedious process of labor certification.
- EB-1(a) visas: If you meet the criteria for a person of extraordinary ability, you may be eligible for an EB-1(a) first preference visa, which does not require labor certification or a job offer.
- EB-1(b) visas: If you are considered an outstanding researcher or professor, you may be eligible for an EB-1(b) visa, which also avoids the lengthy and tedious process of labor certification.
